CINE BUZZ Students

1.1 These Terms and Conditions form the basis of the GU/BCC/Event Cinemas CINE BUZZ Students Program. They are intended to protect both Members and GU/BCC/Event Cinemas. It is a Member’s responsibility to read and understand them. We ask that you read them carefully.

1.2 Use of your Membership Card signifies your acceptance of the current Terms and Conditions of the Program.

1.3 These Terms and Conditions are effective as at 01/02/12 and may be amended from time to time. Members should refer to eventcinemas.com.au for the current Terms and Conditions.

1.4 Every Member is subject to these Terms and Conditions.

In these Terms and Conditions, the following words and expressions shall have the meanings as defined below unless the context otherwise requires:

"Card" means any temporary or permanent membership card issued by GU/BCC/Event Cinemas to identify the Member as a participant of the GU/BCC/Event Cinemas CINE BUZZ Students Program and to enable a Member to utilise the benefits and privileges of the Program.

"Member" means a person who has been admitted by GU/BCC/Event Cinemas as a participant in the Program and is being recognised as a participant for the time being.

"Membership" means the participation of a Member in the Program.

"Participating Cinemas" means the cinemas designated by GU/BCC/Event Cinemas from time to time as "Participating Cinemas" for the purpose of the Program, as specified below under the heading "Participating Cinemas". To avoid doubt, the CINE BUZZ Students Program is not valid for Moonlight Cinemas and Village Cinemas,

"Program" means the GU/BCC/Event Cinemas CINE BUZZ Students Program.

"Program Partner" means an entity with which GU/BCC/Event Cinemas has entered into an agreement to provide Members goods and/or services under an arrangement especially for Program Members.

"GU/BCC/Event Cinemas" means The Greater Union Organisation Pty Ltd and Birch Carroll & Coyle Limited and any of their related companies which own or operate the Participating Cinemas

"Terms and Conditions" means the terms and conditions of the Program as set out here and as may be changed from time to time by GU/BCC/Event Cinemas, at its discretion.

"Standard Session" means any movie session in a standard auditorium but expressly excluding Gold Class Sessions, Vmax Sessions, Movie Marathons, 3D sessions or any other special event screening determined by GU/BCC/Event to be a special event.

"Gold Class Session" means any session screened in a Gold Class auditorium, where Gold Class pricing applies.

"Vmax Session" means any session screened in a Vmax auditorium, where Vmax pricing applies.

3.1 Membership of the GU/BCC/Event Cinemas CINE BUZZ Students Program is free of charge.

4.1 Membership of GU/BCC/Event Cinemas CINE BUZZ Students Program is open to individuals residing in Australia and who have a valid email address and a current student card issued by an Australian based educational institution.

4.2 Membership eligibility of GU/BCC/Event Cinemas CINE BUZZ Students Program is at the sole discretion of GU/BCC/Event Cinemas.

4.3 Membership can only be held by an individual. Membership is not open to families, groups, companies, trusts, partnerships, other entities, government departments or agencies. Individual employees of a corporation or other entity can be enrolled as individual members.

5.1 The GU/BCC/Event Cinemas CINE BUZZ Students Program has its own Membership Card. Members should keep their Card secure.

5.2 The Membership Card is not transferable and must not be given to other individuals to secure benefits from the Program. The Membership Card remains at all times the property of GU/BCC/Event Cinemas.

5.3 The Membership Card should be presented at the box office or candy bar at a Participating Cinema when making a ticket purchase. When making a ticket purchase online, the barcode from the Membership Card will required to be inputted by the Member during the transaction process.

5.4 If the Membership Card is lost or stolen the Member must immediately advise GU/BCC/Event Cinemas. In the first instance GU/BCC/Event Cinemas will replace the Card; thereafter the Member may be charged a replacement fee of $10 at GU/BCC/Event Cinemas’ discretion.

5.5 GU/BCC/Event Cinemas shall be entitled to assume that any person that purports to be a Member and provides (whether in person or through any electronic, telecommunications or other media) the Membership number to GU/BCC/Event Cinemas is in fact the Member. GU/BCC/Event Cinemas shall be entitled to: reveal to any such person any and all information relating to their Membership and Membership bookings, and treat and act on any request of such a person with respect to any other matter regarding the Program without taking any further steps to verify the identity of the person.

6.1 The period of Membership for the GU/BCC/Event Cinemas CINE BUZZ Students Program is from the date of enrolment by the Member until the expiry date communicated to the Member either via the expiry date on the Member’s Membership Card or dedicated e-newsletter communication from GU/BCC Event Cinemas,

6.2 Membership may be immediately terminated by either the Member or GU/BCC/Event Cinemas at any time, with no prior notice required.

7.1 The Member must present their Membership Card when purchasing tickets. The barcode number from the Card must be entered when purchasing tickets online.

7.2 Use of the Membership number and/or Member Card to secure benefits of Membership signifies acceptance of these Terms and Conditions.

7.3 Members who join GU/BCC/Event Cinemas CINE BUZZ Students Program on campus or at a Participating Cinema may be allocated a permanent or temporary Membership Card at that time. However, for the Member to complete enrolment and fully activate their Membership, they need to go online at cheapstudentmovies.com.au and provide details to complete their enrolment. This will then allow the Member to access special priced Member tickets on an on-going basis until the Member’s membership expires.

8.1 GU/BCC/Event Cinemas does not guarantee or warrant that any or all of the benefits or privileges of the Program will be available at all times. GU/BCC/Event Cinemas reserves the right to change, modify, limit or cancel any of the Program benefits at any time without prior notice. This includes increasing or decreasing any requirements for a reward, changing the value of rewards or limiting the availability of rewards. This also includes changing the list of Participating Cinemas covered by the Program.

8.2 Discounted Sessions: Members can redeem $9 movie tickets online or at the box office for any Standard Session on Mondays, or for any Standard Session commencing between 3.00pm and 5.00pm on Tuesdays, Wednesdays and Thursdays, excluding on public holidays in all Participating Cinemas outside of Brisbane. In Brisbane, Members can redeem $8 movie tickets online or at the box office for any Standard Session on Mondays, or for any Standard Session commencing between 3.00pm and 5.00pm on Tuesdays, Wednesdays and Thursdays, excluding on public holidays.

8.3 Booking fees apply in relation to online ticket purchases. The Member must pay the relevant online booking fee in addition to the CINE BUZZ Students standard ticket price applicable to the Program.

9.1 In order to ensure that Member bookings can be tracked to deliver Program benefits, Members must make paid ticket bookings either online via cheapstudentmovies.com.au or eventcinemas.com.au and include their Membership number in the booking. Alternatively, tickets may be purchased at the cinema box office or candy bar, with the Member presenting their Membership Card to the cashier at the beginning of the transaction

10.1 GU/BCC/Event Cinemas reserves the right to terminate the Membership, including forfeiture of rewards, of any Member at any time without providing any reason or giving any notice.

10.2 Any fraud, misuse or abuse concerning the Membership, the Card and/or privileges and benefits relating to the Program will be subject to appropriate administrative and/or legal action by GU/BCC/Event Cinemas.

10.3 Nothing in these Terms and Conditions of Membership shall limit GU/BCC/Event Cinemas in the exercise of any legal or equitable rights and remedies.

10.4 Subject to applicable laws, GU/BCC/Event Cinemas will not be liable for any loss or damage whatsoever suffered by any Member as a result of the termination, suspension or cancellation of their Membership for any reason.

11.1 The Program and the Member’s entitlements to any benefits under the Program are subject to all laws applicable to GU/BCC/Event Cinemas and to the Member which restrict, prohibit or limit the scope or extent of the Program or any benefits or privileges.

11.2 Rewards under the Program may be subject to tax liability. Any tax liability, including disclosure, connected with the receipt or use of the programs is the responsibility of the Member.

12.1 GU/BCC/Event Cinemas reserves the right to amend or alter the Terms and Conditions of the GU/BCC/Event Cinemas CINE BUZZ Students Program at any time. All interpretations of these Membership rules and regulations and conditions shall be at the sole discretion of GU/BCC/Event Cinemas.

13.1 The Terms and Conditions of Membership of the GU/BCC/Event Cinemas CINE BUZZ Students Program are governed by and will be construed in accordance with the laws of New South Wales, Australia irrespective of where the application for Membership has been completed by the Member and submitted to GU/BCC/Event Cinemas. In any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions or Membership, the Member submits to the non-exclusive jurisdiction of the courts of the State of New South Wales.

13.2 Nothing in these Terms and Conditions affects any rights a Member may have and which by law cannot be excluded, including under the Trade Practices Act 1974 (Cth).

13.3 If part or all of any clause in these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
