CINE BUZZ

1.1 These Terms and Conditions form the basis of the GU/BCC/Event Cinemas Cinebuzz Program. They are intended to protect both Members and GU/BCC/EVENT cinemas. It is a Member’s responsibility to read and understand them. We ask that you read them carefully.

1.2 Use of your Membership Card signifies your acceptance of the current Terms and Conditions of the Program.

1.3 These Terms and Conditions are effective as at 01/07/09 and may be amended from time to time. Members should refer to www.eventcinemas.com.au for the current Terms and Conditions.

1.4 Every Member is subject to these Terms and Conditions

In these Terms and Conditions, the following words and expressions shall have the meanings as defined below unless the context otherwise requires:

"Card" means a card issued by GU/BCC/EVENT Cinemas to identify the Member as a participant of the GU/BCC/Event Cinemas Cinebuzz Program and to enable a Member to utilise the benefits and privileges of the Program.

"Free Movie" provides for the Member to receive a complimentary movie ticket, subject to availability, to a standard session at no cost at any GU/BCC/EVENT cinema Australia wide.

"Member" means a person who has been admitted by GU/BCC/EVENT Cinemas as a participant in the Program and is being recognised as a participant for the time being.

"Membership" means the participation of a Member in the Program.

"Participating Cinemas" means the cinemas designated by GU/BCC/EVENT Cinemas from time to time as "Participating Cinemas" for the purpose of the Program. This excludes Beverly Hills & Cronulla cinemas

"Program" means the GU/BCC/Event Cinemas Cinebuzz Program.

"Program Partner" means an entity with which GU/BCC/EVENT has entered into an agreement to provide Members goods and/or services under an arrangement especially for Program Members.

"GU/BCC/EVENT Cinemas" means cinemas owned or managed by The Greater Union Organisation.

"Terms and Conditions" means the terms and conditions of the Program as set out here and as may be changed from time to time by GU/BCC/EVENT Cinemas, at its discretion.

"Standard Session" means any session excluding Gold Class, Vmax, Silverscreen, Movie Marathons, 3D sessions or any other special event determined by GU/BCC/EVENT to be a special event.

"Gold Class Session" means any session screened in a Gold Class auditorium, where Gold Class pricing applies.

3.1 Membership of the GU/BCC/Event Cinemas Cinebuzz Program is free of charge.

4.1 Membership of GU/BCC/Event Cinemas Cine buzz Program is open to individuals residing in Australia of 15 years of age or more and who have a valid email address.

4.2 Members of the GU/BCC/EVENT Seniors Club may also be members of the GU/BCC/Event Cinemas Cinebuzz Program and, if so, receive the benefits of both programs simultaneously.

4.3 Membership eligibility of GU/BCC/Event Cinemas Cinebuzz is at the sole discretion of GU/BCC/EVENT Cinemas Limited.

4.4 Membership can only be held by an individual. Membership is not open to families, groups, companies, trusts, partnerships, other entities, government departments or agencies. Individual employees of a corporation or other entity can be enrolled as individual members.

4.6 Employees of GU/BCC/EVENT Cinemas Limited are not eligible to participate in the Program.

5.1 The GU/BCC/Event Cinemas Cinebuzz Program has its own distinctive Membership Card. Members should keep their card secure.

5.2 The card is not transferable and must not be given to other individuals to secure benefits from the Program.

5.3 The Membership Card should be presented at the box office or candy bar when making any purchase.

5.4 If the card is lost or stolen the Member will immediately advise GU/BCC/EVENT Cinemas. In the first instance GU/BCC/EVENT will replace the card, thereafter the member may be charged a replacement fee of $10 at GU/BCC/EVENT’s discretion.

5.5 GU/BCC/EVENT Cinemas shall be entitled to assume that any person that purports to be a Member and provides (whether in person or through any electronic, telecommunications or other media) the Membership number to GU/BCC/EVENT Cinemas is in fact the Member. GU/BCC/EVENT shall be entitled to: reveal to any such person any and all information relating to their Membership and Membership bookings, and treat and act on any request of such a person with respect to any other matter regarding the Program without taking any further steps to verify the identity of the person.

The Period of Membership for the GU/BCC/Event Cinemas Cinebuzz Program is from the date of enrolment by the Member until terminated by either the Member or GU/BCC/EVENT.

7. Activation of membership and use of membership card

7.1 Members who join GU/BCC/Event Cinemas Cinebuzz online will be allocated, while enrolling, an online version of a Membership Card and associated details. From that point, their Membership is active and may be used.

7.2 The Member should quote their membership number when purchasing tickets or concession items.

7.3 Use of the Membership number and/or Member Card to secure benefits of Membership signifies acceptance of the Terms and Conditions of Membership.

7.4 Members will normally be mailed a Membership Card and related material within 10 days of online enrolment.

7.5 Members who join GU/BCC/Event Cinemas Cinebuzz in cinema will be allocated a permanent membership card at that time. The member can earn points from that time. However, for the Member to complete enrolment and fully activate their Membership, they need to go online and provide details to complete their enrolment. Once this process is complete, points can be redeemed as per the program terms & conditions.

8.1 GU/BCC/EVENT Cinemas does not guarantee or warrant that any or all of the benefits or privileges of the Program will be available at all times. GU/BCC/EVENT Cinemas reserves the right to change, modify, limit or cancel any of the Program benefits at any time. This includes increasing or decreasing any requirements for a reward, changing the value of rewards or limiting the availability of rewards. This also includes changing the locations served by Program.

8.2 Points Earning: Members will earn 10 bonus starter points at the time of full activation of their Membership. Members will earn 10 points on one paid ticket per session. The ticket purchased must be used by the member. GU/BCC/EVENT may offer bonus points for any particular movie, session, cinema or any combination thereof. There is a limit of 40 points that can be earned in one day by a Member attending up to four sessions in that day. The price of the paid ticket has no bearing on the amount of points the member will earn. Points earned through purchasing tickets will not be credited to the Member’s account until up to 24 hours after the screening. Points cannot be transferred to another member and are not redeemable for cash. Points will not be earned on tickets purchased prior to launch of the programme.

8.3 Points Usage (Burning): Members of can redeem 100 points for 1 free ticket to a Standard Session. Members can not normally redeem points for tickets to non Standard Sessions. GU/BCC/EVENT may offer reduced points redemption for any particular movie, session, cinema or any combination thereof. Points will be removed from the Member’s account at the time of booking or redemption. There are no blackout periods and all Standard Sessions have free member redemption tickets available. However, some sessions have a limited number of free Member tickets available for redemption and once these have been used others will not be made available for redemption. Members may at certain times be able to redeem points for other items/tickets as specified by GU/BCC/EVENT. Free tickets must be booked online. Membership points will expire 2 years after being earned. From Jan 01 2012 this will be assessed on a monthly basis.

8.4 24 Hours Advance Ticket Window: GU/BCC/Event Cinemas Cinebuzz Members will have access to book tickets to selected films 24 hours before non members.

8.5 Program Partner/s: The Program may include offers to Members from time to time from third party entities other than GU/BCC/EVENT Cinemas. These offers are accepted by GU/BCC/EVENT in good faith as to the appropriateness of the offer for Members and the ability of the third party to deliver in accordance with any offer they make. GU/BCC/EVENT accepts no responsibility or liability whatsoever with regard any matter that may arise between the Member and any third party in relation to any offer that a third party has made through the Program.

8.6 Flash Promotions: Members who have their Card scanned or buy tickets online may go into the draw to ad-hoc competitions and are subject to the terms & conditions of those competitions.

8.7 Flash Offers: Members who have their Card scanned or buy tickets online may receive ad-hoc discounts, offer and rewards. Members are subject to the terms & conditions of such offers.

8.8 Screenings: Members may be eligible to attend special screenings only available to Program Members, or available to members at a discount price. Members must have their Card scanned as proof of membership. Membership does not guarantee entry to these screenings and are only available while tickets last.

8.9 Movie Saver Discounts: Discount applies only to postcodes that the offer is distributed to. Movie Saver Recognitions cannot be used for VMAX, 3D, Gold Class, Movie Marathons or any other special events. $1 Booking Fee applies per ticket purchased

Each Seniors Club Online Member can purchase a single $8 ticket to attend any Standard Session at Participating Cinemas, but expressly excluding Standard Sessions after 5pm on Saturdays. Members who purchase a ticket for a Standard Session after 5pm on Saturdays at normal prices may be eligible for other benefits of Membership as determined by AHL from time to time.

9.1 In order to ensure that Member bookings can be tracked to deliver Program benefits, Members must make paid ticket bookings either: online at www.eventcinemas.com.au, including their Membership number in the booking, or At the cinema box office or candy bar, presenting their card to the cashier at the beginning of the transaction.

9.2 Members may only book free redemption tickets online at www.eventcinemas.com.au. They must enter their Membership number and follow the prompts associated with online redemption bookings.

10.1 GU/BCC/EVENT reserves the right to terminate the Membership, including forfeiture of rewards, of any Member at any time without assigning any reason or giving any notice.

10.2 Fraud or abuse concerning the membership and/or privileges and benefits is subject to appropriate administrative and/or legal action by GU/BCC/EVENT Cinemas Limited.

10.3 Nothing in these Terms and Conditions of Membership shall limit GU/BCC/EVENT Cinemas in the exercise of any legal or equitable rights and remedies.

10.4 Subject to applicable laws, GU/BCC/EVENT Cinemas will not be liable for any loss or damage whatsoever suffered by any Member as a result of such termination, suspension or cancellation.

11.1 The Program and the Member’s entitlements to any benefits under the Program are subject to all laws applicable to GU/BCC/EVENT Cinemas and to the Member which restrict, prohibit or limit the scope or extent of the Program or any benefits or privileges.

11.2 Rewards under the programs may be subject to tax liability. Any tax liability, including disclosure, connected with the receipt or use of the programs is the responsibility of the Member.

12.1 GU/BCC/EVENT Cinemas Limited reserves the right to amend or alter the Terms and Conditions of the GU/BCC/Event Cinemas Cinebuzz Program at any time. All interpretations of these Membership rules and regulations and conditions shall be at the sole discretion of GU/BCC/EVENT Cinemas Limited.

13.1 The Terms and Conditions of Membership of the GU/BCC/Event Cinemas Cinebuzz Program are governed and will be construed in accordance with the laws on New South Wales, Australia irrespective of where the application for Membership has been completed by the Member and submitted to GU/BCC/EVENT Cinemas. In any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions or Membership, the Member submits to the non-exclusive jurisdiction of the State of New South Wales.

13.2 Nothing in these Terms and Conditions affects any rights a Member may have and which by law cannot be excluded, including under the Trade Practices Act (1974).

13.3 If part or all of any clause in these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
